Helping Victims Of Child Sexual Abuse Seek Justice
As countless people continue to courageously come forward to share their accounts about the sexual abuse they suffered as children, it was clear that New York law did not give many of them the chance to seek justice and hold their abusers accountable. That all changed this year, when Governor Cuomo signed the Child Victims Act, New York, into law.
This law will give people much more time to bring civil lawsuits against those who abused them, and the institutions that employed and sheltered these predators. If you suffered abuse as a child, our trial attorneys here at Silver & Kelmachter, LLP of New York City can help you pursue the long-delayed justice that you deserve.
What Does The Child Victims Act, New York, Do?
Previously, New York law placed strict limits on how long someone could wait to come forward and seek criminal charges or a lawsuit against sexual abusers. Now, the new law:
- Allows victims of abuse to file a lawsuit seeking compensation before their 55th birthday, a drastic increase from the previous law’s limit of age 23
- Starting on August 14, 2019, anyone who was previously ineligible from filing a lawsuit will have a one-year window to proceed with a lawsuit
- No longer requires that a notice of claim be filed when sexual offenses are committed against a minor
- Increases the age that victims may come forward to 28 years old to seek criminal prosecution against abusers
Get The Help That You Need
There is no amount of compensation that can make up for what was taken from you at such a young age. However, moving forward with a lawsuit, even years or decades later, can send an important message to churches, companies, day cares, schools and other organizations that harbored abusers for years. It can also help other victims come forward. This compensation can also help you better afford any medical bills and lost wages that resulted from your treatment.
Of course, seeking compensation is still a complex process, and the other side will work hard to limit the damage. That means you need the experienced, aggressive attorneys in your corner to fight for what you deserve. At Silver & Kelmachter, LLP, we are led by proven trial attorneys who each have more than 30 years of experience seeking justice on behalf of everyday New Yorkers. We know what it takes to get results.
